“Software” means the SMKRV MCP Studio software, comprising all source code (whether in clear-text or obfuscated form), object code, compiled binaries, Docker images, container configurations, documentation, templates, generated code, configuration files, and any other materials authored by the Licensor and distributed through the channels listed above or any other medium. “Obfuscated Components” means those portions of the Software that have been intentionally obfuscated, compiled, minified, or otherwise rendered not readily human-readable by the Licensor for the purpose of intellectual-property protection. These portions are identified at the Licensor’s sole discretion. “Third-Party Components” means open-source or third-party libraries, frameworks, packages, and dependencies that are included in, bundled with, or required by the Software, each of which is governed exclusively by its own license (see Section 12). “Licensor” means Sergey Makarov, the sole author and copyright holder. “You” (or “Your”) means the natural person or legal entity agreeing to and exercising the rights granted under this License. “Your Company” means any legal entity, sole proprietorship, or other kind of organization that You work for, plus all its Affiliates. “Affiliates” means any organizations that an organization has Control over, is under the Control of, or is under common Control with. “Control” means ownership of substantially all the assets of an entity, or the power to direct its management and policies by vote, contract, or otherwise. Control can be direct or indirect. “Commercial Use” means any use of the Software that is intended for or directed toward commercial advantage or monetary compensation, including but not limited to: (a) selling, licensing, sublicensing, or distributing the Software or derivative works thereof for a fee; (b) providing hosted, managed, or SaaS services based in whole or in part on the Software to third parties for compensation; (c) deploying the Software to generate revenue, whether directly or indirectly; (d) incorporating the Software or any part thereof into a commercially offered product or service. “Non-Commercial Use” means any use of the Software that does not constitute Commercial Use, including personal projects, academic research, educational activities, internal evaluation, non-profit organizational use, and contributions to non-revenue-generating community projects. Use by any charitable organization, educational institution, public research organization, public safety or health organization, environmental protection organization, or government institution is Non-Commercial Use regardless of the source of funding or obligations resulting from such funding.2. Grant of License - Non-Commercial Use
Subject to the terms and conditions of this License, the Licensor hereby grants You a worldwide, royalty-free, non-exclusive, non-transferable, non-sublicensable, revocable license to:- (a) download, install, and run the Software;
- (b) use the Software for any Non-Commercial Use without limitation;
- (c) make copies of the Software in unmodified form for backup or archival purposes;
- (d) create derivative works based on the non-obfuscated portions of the Software for Your own Non-Commercial Use;
- (e) publicly display or demonstrate the Software in a non-commercial context, provided that attribution to the Licensor is maintained.
3. Restrictions
You may NOT, without the prior express written permission of the Licensor:- (a) Use the Software for any Commercial Use (see Section 4);
- (b) Reverse engineer, decompile, disassemble, decrypt, de-obfuscate, or otherwise attempt to derive the source code, algorithms, data structures, or trade secrets contained in the Obfuscated Components, except and only to the limited extent that such activity is expressly permitted by applicable mandatory law (such as EU Directive 2009/24/EC, Article 6, for interoperability purposes only) and cannot be waived by contract;
- (c) Remove, alter, conceal, or obscure any copyright notice, trademark, attribution, proprietary legend, or this License text contained in or affixed to the Software;
- (d) Distribute, sublicense, sell, lease, rent, pledge, or otherwise transfer the Software or any portion thereof to any third party, except as expressly permitted by this License or as required by the terms of Third-Party Components;
- (e) Use the Software, in whole or in part, to build, train, or improve a competing or substantially similar product or service;
- (f) Circumvent, disable, or interfere with any technical protection measures, license-key mechanisms, or access controls embedded in the Software;
- (g) Represent or imply that the Licensor endorses or is affiliated with Your products, services, or activities, unless the Licensor has granted written permission to do so;
- (h) Use the Software in any manner that violates applicable local, national, or international law or regulation.
4. Commercial Licensing
Any Commercial Use of the Software requires a separate written commercial license agreement with the Licensor. Unauthorized Commercial Use constitutes a material breach of this License and an infringement of the Licensor’s intellectual-property rights.Commercial license inquiries:

5. Patent License and Patent Defense
5.1 The Licensor grants You a patent license for the Software that covers patent claims the Licensor can license, or becomes able to license, that You would infringe by using the Software solely for Non-Commercial Use in accordance with this License. 5.2 If You or Your Company make any written claim that the Software infringes or contributes to infringement of any patent, Your patent license for the Software granted under Section 5.1 ends immediately. If Your Company makes such a claim, Your patent license ends immediately for all work on behalf of Your Company.6. Intellectual Property
6.1 The Software, including all Obfuscated Components, and all copies, modifications, and derivative works thereof, are and shall remain the exclusive property of the Licensor. This License does not convey to You any ownership interest in or to the Software. 6.2 All rights not expressly granted herein are reserved by the Licensor. Nothing in this License shall be construed as granting, by implication, estoppel, or otherwise, any license or right to any trademark, service mark, trade name, or trade secret of the Licensor (patent rights are addressed solely in Section 5). 6.3 If You provide the Licensor with any feedback, suggestions, or ideas regarding the Software (“Feedback”), You hereby assign to the Licensor all right, title, and interest in such Feedback without restriction and without obligation of compensation.7. Fair Use
You may have “fair use”, “fair dealing”, or other similar rights for the Software under applicable law. Nothing in this License is intended to limit or restrict those rights.8. GitHub Public Repository - Additional Terms
Where the Software is made available through a public repository on GitHub.com, You acknowledge that:- (a) GitHub’s Terms of Service (Section D.5) grant each GitHub user a non-exclusive, worldwide license to use, display, and perform the Software through GitHub’s service, and to fork and reproduce the Software solely as permitted by GitHub’s functionality. These implicit rights are limited to interactions within the GitHub platform and do not extend to any use, distribution, or exploitation of the Software outside of GitHub.
- (b) Forking the repository on GitHub does not grant any additional license rights beyond those stated in this License and GitHub’s Terms of Service Section D.5.
- (c) All restrictions in Sections 3 and 4 remain in full force and effect, including the prohibition on reverse engineering of Obfuscated Components and the restriction on Commercial Use.
- (d) The inclusion of certain source files in obfuscated form within a public repository is an intentional intellectual-property protection measure. GitHub’s Terms of Service permit repositories to contain proprietary code under custom licenses.
9. Docker Images - Additional Terms
Docker images published under the namesmkrv/smkrv-mcp-studio on Docker Hub or any other container registry are distributed under the terms of this License. Pulling, running, or deploying such images constitutes acceptance of this License. The same restrictions on Commercial Use and reverse engineering apply to container images and their contents.
10. Termination
10.1 This License is effective until terminated. 10.2 The Licensor may terminate this License at any time, with or without cause, by providing written notice (including electronic notice). 10.3 CURE PERIOD. The first time You are notified in writing that You have violated any of these terms, or done anything with the Software not covered by Your license grant, Your license can nonetheless continue if You come into full compliance with these terms and take practical steps to correct past violations within thirty (30) consecutive calendar days of receiving such notice. If You fail to cure the violation within the cure period, all Your licenses under this License end immediately. 10.4 IMMEDIATE TERMINATION. Notwithstanding Section 10.3, the following violations result in immediate termination without a cure period: (a) unauthorized Commercial Use; (b) reverse engineering of Obfuscated Components; (c) circumvention of technical protection measures; or (d) any repeated violation after a prior cure period has been exercised. 10.5 Upon termination, You must immediately cease all use of the Software and destroy all copies (including derivative works and backups) in Your possession or control. 10.6 Sections 3 (Restrictions), 5 (Patent License and Patent Defense), 6 (Intellectual Property), 7 (Fair Use), 9 (Docker Images), 11 (Disclaimer of Warranties), 13 (Limitation of Liability), and 15 (Severability) survive termination of this License.11. Disclaimer of Warranties
THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND ABSENCE OF DEFECTS (WHETHER LATENT OR PATENT). THE LICENSOR MAKES NO WARRANTY THAT THE SOFTWARE WILL: (A) MEET YOUR REQUIREMENTS; (B) OPERATE WITHOUT INTERRUPTION OR ERROR; (C) BE COMPATIBLE WITH ANY THIRD-PARTY SOFTWARE, HARDWARE, OR SERVICE; (D) BE SECURE OR FREE FROM VULNERABILITIES; OR (E) PRODUCE ACCURATE OR RELIABLE RESULTS. YOU ASSUME THE ENTIRE RISK AS TO THE QUALITY, PERFORMANCE, AND SUITABILITY OF THE SOFTWARE. SHOULD THE SOFTWARE PROVE DEFECTIVE, YOU (AND NOT THE LICENSOR) ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES. IN SUCH JURISDICTIONS, THE ABOVE EXCLUSIONS APPLY TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.12. Third-Party Components and Open-Source Acknowledgment
The Software incorporates Third-Party Components distributed under their own open-source or permissive licenses, including but not limited to:
Nothing in this License is intended to limit, restrict, or otherwise affect the rights You have under the licenses of those Third-Party Components. To the extent there is any conflict between this License and the license of a Third-Party Component with respect to that component, the Third-Party Component’s own license shall prevail for that component only.
The Licensor’s proprietary rights under this License apply exclusively to original code, templates, configurations, documentation, and other materials authored by the Licensor, and do not extend to Third-Party Components.
