1. Definitions

“Software” means SMKRV MCP Studio, including all source code, object code, documentation, configuration files, Docker images, templates, and any other materials provided or made available by the Licensor. “Licensor” means Sergey Makarov. “Commercial Use” means any use of the Software intended for or directed toward commercial advantage or monetary compensation, including but not limited to: selling, licensing, or sublicensing the Software or derivative works; providing hosted or managed services based on the Software to third parties for a fee; incorporating the Software into a product or service offered commercially.

2. Grant of License

Subject to the terms of this License, the Licensor grants you a limited, non-exclusive, non-transferable, revocable license to use the Software solely for personal, educational, or internal evaluation purposes.

3. Restrictions

You may NOT, without prior written permission from the Licensor:
  1. Use the Software for any Commercial Use
  2. Distribute, sublicense, sell, lease, rent, or otherwise transfer the Software or any portion thereof to any third party
  3. Modify, adapt, translate, or create derivative works based on the Software for any purpose other than personal, non-commercial use
  4. Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software, except to the extent expressly permitted by applicable law
  5. Remove, alter, or obscure any copyright, trademark, or other proprietary notices contained in the Software
  6. Use the Software to build a competing product or service

4. Commercial Licensing

5. Intellectual Property

The Software and all copies thereof are proprietary to and the property of the Licensor. All rights in the Software not specifically granted in this License are reserved to the Licensor. This License does not grant you any rights to trademarks, service marks, or trade names of the Licensor.

6. No Warranty

THE SOFTWARE IS PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. THE LICENSOR DOES NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED.

7. Limitation of Liability

IN NO EVENT SHALL THE LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE SOFTWARE; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF THE SOFTWARE; OR (C) ANY OTHER MATTER RELATING TO THE SOFTWARE.

8. Termination

This License is effective until terminated. The Licensor may terminate this License at any time if you breach any of its terms. Upon termination, you must immediately cease all use of the Software and destroy all copies in your possession.

9. Governing Law

This License shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.

10. Entire Agreement

This License constitutes the entire agreement between you and the Licensor regarding the Software and supersedes all prior or contemporaneous communications, whether written or oral.
